If pics can’t be deleted from my folder cause it delete them from sub folders also
is there a way to make a folder on the home screen and put pics in that

No. Unfortunately Apple doesn’t allow you to move photos into an album, only copy them there.
My solution was the app ‘Slidebox’. It gives you a list of all your photos and when you sort them into an album, they disappear from the ‘unsorted’ list.
